5.9 Special Rules Regarding Calculation of Benefits
If you retired and then return to Covered Employment on or before August 31, 1999, see Appendix D for special rules that apply to the benefits you earned on your return to Covered Employment. In Appendix E, special rules that apply to Past Benefit Service granted before July 1, 2001 are described. See Appendix F for special rules that apply to benefits accrued before July 1, 1990. See Appendix G for your benefits accrued during Plan Years 1991 to 1997 if you earned less than 1,000 Contributory Hours after June 30, 1997.
If you receive benefits under the Overlay described in Section 5.5, you are entitled to the retirement benefits, forms, amounts, and timing as described in Sections 4 and 5, When You May Retire and How Your Benefit Is Calculated, and not in the Appendices. For example, if you receive Overlay benefits you are not entitled to a lump sum payment, and you are not entitled to the Retirement Ages or benefits described in Appendix F. If you do not receive benefits under the Overlay, your monthly benefit at Normal Retirement Age for service before July 1, 1990 will be determined according to Appendix F.
In any event, your benefit at Normal Retirement Age for accruals before July 1, 1990 combined with your benefit at Normal Retirement Age for accruals after June 30, 1990 will never be less than the actuarial equivalent of the greater of the Normal Retirement Age benefit under this Section 5 or under Appendix F.
